Microsoft confirms zero-day bug in IE6, IE7 and IE8

Computerworld - Microsoft on Saturday confirmed that Internet Explorer (IE) 6, 7 and 8 contain an unpatched bug -- or "zero-day" vulnerability -- that is being used by attackers to hijack victims' Windows computers.

The company is "working around the clock" on a patch, its engineers said. They have also released a preliminary workaround that will protect affected IE customers until the update is ready.

In a security advisory issued Dec. 29, Microsoft acknowledged that attacks are taking place. "Microsoft is aware of targeted attacks that attempt to exploit this vulnerability through Internet Explorer 8," the alert stated.

Newer versions of IE, including 2011's IE9 and this year's IE10, are not affected, Microsoft said. It urged those able to upgrade to do so.

According to multiple security firms, the vulnerability was used by hackers to exploit Windows PCs whose owners visited the website of the Council on Foreign Relations (CFR), a non-partisan foreign policy think tank with offices in New York and Washington, D.C.

On Friday, FireEye corroborated earlier reports that the CFR website had been compromised by attackers and was hosting exploit code as early as Dec. 21. As of mid-day Wednesday, Dec. 26, the site was still conducting "drive-by" attacks against people running IE8, said Darien Kindlund, senior staff scientist at FireEye, in a Friday blog.

Kindlund added that the malware hidden on the CFR website used Adobe Flash Player "to generate a heap spray attack" against IE8. It wasn't clear whether Flash also contained a zero-day bug, or whether the attackers leveraged an already-known and previously patched vulnerability that had not been fixed on the victims' PCs.

On Saturday, Jaime Blasco, the labs manager at AlienVault, weighed in on the IE zero-day as well, noting that the exploit was able to circumvent Microsoft's anti-exploit technologies, DEP (data execution prevention) and ASLR (address space layout randomization), and successfully compromise Windows XP and Windows 7 PCs running IE8. He identified the IE bug as a likely "use-after-free" vulnerability, a type of memory management flaw.

AlienVault, said Blasco, had begun looking into the "watering hole" attacks stemming from the CFR website at the beginning of the week, and had alerted the Microsoft Security Response Center (MSRC) that it suspected IE harbored a zero-day vulnerability.

In a watering hole campaign, hackers identify their intended targets, even to the individual level, then scout out which websites they frequently visit. Attackers next compromise one or more of those sites, plant malware on them, and like a lion waits at a watering hole for unwary wildebeests, wait for unsuspecting users to surf there.

The CFR did not immediately reply to a request for comment on its site's current status.

Dot Earth Blog: Coal Giant Peabody Drops Claim it is the 'Global Leader in Clean Energy Solutions'

Peabody Energy, the biggest private-sector coal company in the world, has removed the claim that it is ?the global leader in clean energy solutions? from its home page. The two images below show the shift (sometime between Dec. 19 and Dec. 29), with the claim now reading that it the company is ?the global leader in clean coal solutions?:

I?d questioned that clean-energy assertion in a post a few days ago.

As for the new ?clean coal? claims, I encourage you to revisit the statement from my initial post by Vic Svec, a senior vice president at Peabody, and then read what David Hawkins of the Natural Resources Defense Council posted in a comment. Both are reproduced here:

Vic Svec:

We note on the front page of our website that Peabody Energy is the world?s largest private-sector coal company and a global leader in sustainable mining and clean coal solutions. One of the great untold environmental stories is the enormous progress in clean energy that has occurred in recent decades.

We forget to celebrate the enormous progress that has been made in clean coal in recent decades. The core U.S. coal statistic is this: criteria emissions from coal use in the U.S. have declined a stunning 87% since 1970, during a time when coal use has nearly tripled. ?Smokestacks? for coal plants have now become steam stacks, thanks to wet and dry ESPs, baghouses, low-NOx burners, SCRs, activated carbon injection and a host of other technologies.

In addition, using coal in large centralized plants dramatically reduces the burning of fuel wood and waste that causes enormous indoor air pollution in developing nations. And we know that low-cost coal-fueled electricity has helped to bring about an explosion of electrotechnologies: your coal-fueled mail delivery ? e-mail ? has dramatically lower emissions than traditional mail.

New supercritical coal plants represent another leap forward. Consider the Prairie State Energy Campus, with more than $1 billion in clean coal technologies and criteria emissions some 80% below the existing coal fleet? along with a carbon dioxide emission rate some 40% below existing plants. Prairie State is also a great example of green jobs, with thousands of workers involved in construction of the large coal plant. And Prairie State has a cost of fuel that less than one-third that of even currently suppressed U.S. natural gas prices.

Ironically, U.S. environmentalists have been a major reason more supercritical coal plants haven?t been used in the United States, even taking credit for killing state-of-the-art new coal construction in the past decade. China is building far more such plants because they recognize that coal is essential to power a healthy economy and the new generation of coal plants offer great environmental advantage. Also, Peabody is proud to be the only non-Chinese partner in GreenGen, which just started up in Tianjin, China, as a major coal gasification plant that will ultimately reuse carbon dioxide for enhanced oil recovery.

Coal has been the fastest growing fuel in the world for the past decade, and has been projected to pass oil as the world?s largest energy source next year. Its abundance and low-cost profile make coal essential for powering the world?s best economies and helping to move hundreds of millions of people to cities? and to the middle class. Those are enormous societal benefits, and technology can ensure that his be done in an environmentally friendly way.

David Hawkins:

Vic?s message is rife with omissions and evasions. His complaint about the untold story of improved emissions from coal plants is ironic, given the parts he chooses to leave untold: that coal producers and coal plant operators fought every single one of the policies that produced these gains; that they continue to fight the policies that could produce similar gains for carbon dioxide if adopted; and that Peabody is truly a world leader in funding the campaigns to block meaningful action against global warming pollution.

Next, he switches the subject from coal to electricity. No environmentalists I know are opposed to electrification. To conflate the benefits of electricity with the need to use coal as it is used today, is deeply dishonest.

Building new supercritical coal plants is a climate protection strategy only in Orwell?s world. Protecting the climate means curbing cumulative emissions. New supercritical coal plants are a massive commitment to increased cumulative emissions. There is no irony in the efforts to block these plants and to steer investments to cleaner forms of electricity resources.

If Peabody were serious about deployment of CCS [carbon dioxide capture and sequestration] it would have supported the Waxman-Markey bill and companion bills in the Senate. Those bills would have made huge subsidies available for CCS and would have set standards requiring its use on the new coal plants that Peabody would like to see built. CCS is not the best tool we have to protect the climate but Vic?s claim that Peabody is a serious promoter of the technology is as misleading as the rest of his message.

US sailors sue Japan's TEPCO for post-quake radiation exposure

A group of U.S. Navy personnel involved in the humanitarian effort after Japan's March 2011 earthquake and tsunami have filed a lawsuit against the Tokyo Electric Power Co. for more than $200 million?in compensation, punitive damages and future medical costs for exposure to radiation that leaked from the damaged Fukushima Nuclear Power Plant at the time.

The plaintiffs include eight troops serving on the USS Ronald Reagan aircraft carrier ? one of whom was pregnant at the time of the alleged exposure ??and her?daughter.

They charge that the utility, known as TEPCO, "knowingly and negligently caused, permitted and allowed misleading information concerning the true condition of the (plant) to be disseminated to the public, including the U.S. Navy Department," according to the complaint filed on Dec. 21 in a U.S. federal court in San Diego.


?The plaintiffs are suffering a variety of symptoms that attorney Paul Garner says were caused by the exposure, including rectal bleeding, thyroid problems and?persistent migraine headaches, and all face an increased chance of developing cancer and requiring expensive medical procedures.

The U.S. carrier was positioned just offshore from the damaged Fukushima Nuclear Power Plant, which and suffered a meltdown which triggered?the release of high levels of radiation into the air and water.

"The carrier was less than two football fields away from the Fukushima Daiichi when it released a cloud of radiation," said Garner, speaking to NBC News on Thursday.

He said the crew was unknowingly exposed to high levels of radiation in numerous ways, including when they cleared the carrier's decks of snow that was contaminated, and washed down the helicopters with sea water that was contaminated.

The complaint said that by relying on misrepresentations about the situation by TEPCO, the U.S. Navy was "lulled into a false sense of security," believing it was "safe to operate with the waters adjacent to the FNPP, without doing research and testing that would have revealed the problems."

It goes on to charge that through its conduct, TEPCO "rendered the Plaintiffs infirm and poisoned their bodies. The Plaintiffs must now endure a lifetime of radiation poisoning and suffering which could have and should have been avoided."

The suit is seeking $10 million in damages for each plaintiff, plus?$30 million in punitive damages and a judgment requiring TEPCO to create $100 million fund to pay for their medical costs, including monitoring and treatments.

TEPCO could not immediately be reached for comment by NBC News.

A TEPCO spokesman reached by?The Japan Times?said the company had not yet received the complaint.

"We will consider a response after examining the claim," said Yusuke Kunikage, according to the Times.

Since the disaster, TEPCO has operated a fund to compensate victims in Japan.

Garner said that he didn't believe his clients would get justice through the Japanese system, which is why the suit was filed in a U.S. court. The complaint was served to TEPCO's office in Washington, D.C. on Thursday, he said.

"We need the U.S. justice system to make this right," Garner said.

How many words to say? The perennial challenge in public speaking

Many speakers can?t work out how many words they can say in the time they?ve got. Whilst there is no substitute for practice, don?t bank on more than 140 words per minute.

An entrepreneur friend of mine was recently on a global trade tour. With a group of his fellow countrymen he was visiting a load of European countries to sell his great new idea. At each event each member of the group was supposed to stand up, give a two minute elevator pitch and sit down. Every single time, one guy would get up and speak for quarter of an hour, dominated the time available and no-one else got a look in. Needless to say he wasn?t the most popular delegate on the trip.

We?ve all been there. A speaker?waffles on for three times as long as anyone anticipates. Sometimes other people miss out on speaking, or they miss their train home. Always it tires the audience.?Over the last few years as an observer of public speaking I?ve seen a lot of speakers overrun. Occasionally a speaker keeps going on?because they like the sound of their own voice. Mostly, it?s borne out of lack of confidence in the speaker themselves.

The greatest fear of any novice public speaker is running out of material. Not having anything to say in front of audience. To be frozen, silent and exposed. As a consequence novice speakers try to pack more into their speeches than they can possibly hope to say in the time available. Experienced speakers do it too, when they?re in front of new audiences that make them nervous.

The answer of course is to plan to say less. But how much less? That?s the tricky part, because it will depend on a wide range of different things, including the density of the content (does the audience have a lot to take in?) and pauses you are inserting for dramatic effect, but here are some helpful tips I?ve picked up along the way.

  • Since we all?speak at different rates, there?s no substitute for practice at home.
  • When performing in front of an audience, I find most speeches take 15% longer than they do with the mirror. That?s a combination of additional pauses for effect, laughter, and allowing the audience to take the content in.
  • If you don?t have time to practice, years of writing my own speeches and reading other people?s suggests most people can say around 140 words?a minute clearly, so that?s about 1,000 words in a seven minute speech. (Having said that, one of my favourite speaking blogs, six minutes, analysed a series of TED talks by leading figures and found the average speaking rate was 163 words per minute, with a range of 133-188. If you ask me, many of them would have been a lot better if they?d slowed down http://sixminutes.dlugan.com/speaking-rate/)
  • Finally, remember that when it comes to speaking, your audience are very unlikely to be more engaged with the subject than you are and the more enthusiastic the speaker the more they want to cram in. If you think it is about the right length, it is probably too long. If you think it is too long, it definitely is. No-one ever condemned a speaker with the words ?that presentation was too short?.

When Lions return man Stefan Logan fielded a kick at the 4-yard line on Saturday against the Falcons, he did something extraordinarily stupid: He took a knee and downed it. At the 4-yard line.

TV cameras caught Lions coach Jim Schwartz calling that, ?the f?king stupidest thing I?ve ever seen.? Now Logan has been benched.

?I won?t be [returning kicks] this Sunday,? Logan confirmed today. ?I?m mad, but at the same time there?s nothing I can do about that. That?s coach?s decision. I blame myself. I?m not blaming the coaches, I blame myself. I?m my worst critic.?

Logan didn?t have much of an explanation for why he downed the ball.

?It was a messed up play by me and I have to live with it and move on from it. It?s just a bad play by me and I have to pay the consequences and I have to live with it. I just have to work through it and just be ready for whenever your opportunity comes back up,? Logan said.

Schwartz said that if Logan can?t be trusted not to down the ball at the 4-yard line, then he can?t be trusted to return kicks.

?Part of a returner?s job is to know where he is on the field. Saying ?I didn?t know where I was, I thought I was in the end zone,? is not a valid excuse. Your job as a returner is to know where you are on the field, particularly after we had gotten a safety,? Schwartz said.

Frankly, Schwartz?s decision to bench Logan is long overdue, regardless of his bonehead play last week. Logan is dead last in the NFL with a 21.3-yard kickoff return average and 16th with a 9.1-yard punt return average, and he has six fumbles this season.

Still, Logan is confident in himself going forward.

?Things happen. I didn?t lose the game,? Logan said. ?The game was already over. So it?s not like I lost the game for us, but you can look at it however you want to look at it. We?ve all struggled as a team so far. Not just one individual. I?m like the quarterback on special teams. When the camera goes on special teams it comes straight to me so if anything happens on special teams as far as muffing a punt or a guy running into me or something like that it?s going to be my fault because the light is on me.?

The reality is that Logan is wrong when he says the game was over. It wasn?t over. The Lions were losing by 13 points with 1:21 remaining at the time of Logan?s blunder, so they certainly weren?t in good shape, but teams have come back from being down 13 with 1:21 remaining and gone on to win. In fact, just this season the Lions came back to force overtime after trailing the Titans by more than 13 with less than 1:21 remaining. In that game, Logan fielded a kick with the Lions down by 14 with 1:16 remaining. Fortunately for the Lions, when Logan downed that kick he really was in the end zone. (Apparently Logan thought at the time that the game was over, but his teammates still fought their way back into it.)

Logan?s ?the game was already over? statement doesn?t speak well for his competitiveness, but Logan said he still expects to be an NFL return man in 2013.

?I?ll just keep moving forward whether it?s with Detroit or another team,? he said.

Given Schwartz?s comments about Logan, it will probably not be with Detroit.

Republican lawmakers set up 11th-hour bid on "fiscal cliff"

WASHINGTON (Reuters) - Lawmakers on Thursday gave themselves a last chance to prevent the United States from plunging off a "fiscal cliff" by setting up a late session in Congress just about a day before taxes are due to rise for most working Americans.

Republican leaders in the House of Representatives told their members to be back in Washington from the Christmas holiday break on Sunday night in case they need to vote on budget measures.

That leaves the door open to a last-minute solution to avert big tax hikes due to begin on January 1 and deep, automatic government spending cuts set to begin on January 2 - together worth $600 billion - that could push the United States back into recession.

But the two political parties remained far apart, particularly over plans to increase taxes on the wealthiest Americans to help close the U.S. budget deficit.

"Hopefully, there is still time for an agreement of some kind that saves the taxpayers from a wholly, wholly preventable economic crisis," Mitch McConnell, the top Republican in the Democratic-controlled Senate, said on the Senate floor.

U.S. stocks sharply cut losses after news of the House reconvening as investors clung to hopes of an 11th-hour deal.

Earlier in the day, Senate Majority Leader Harry Reid, the top Democrat in Congress, warned that the United States looked to be headed over the "fiscal cliff."

"It looks like that is where we're headed," he said on the Senate floor, blaming Republicans for the impasse in talks.

He called on the Republicans who control the House to prevent the worst of the fiscal shock by getting behind a Senate bill to extend existing tax cuts for all except those households earning more than $250,000 a year.

With the clock ticking toward the deadline for action, Reid offered little hope.

"I don't know time-wise how it can happen now," he said.

Referring to the House run by Speaker John Boehner - the top Republican in Congress - Reid said, "It's being operated with a dictatorship of the speaker, not allowing a vast majority of the House of Representatives to get what they want."

Boehner's failed effort last week to push his own "fiscal cliff" solution through the House was a "debacle," Reid added. He also accused Boehner of delaying "fiscal cliff" action until after he seeks re-election as House speaker on January 3.

"John Boehner seems to care more about keeping his speakership than about keeping the nation on firm financial footing," Reid added.

His comments may have been more an attempt to spur Republican rivals into action than a definitive prediction that "fiscal cliff" talks will fail.

OBAMA RETURNS TO WASHINGTON

President Barack Obama arrived back at the White House from a brief vacation in Hawaii to try to restart stalled negotiations with Congress.

The House and Senate passed bills months ago reflecting their own sharply divergent positions on the expiring low tax rates, which went into effect during the administration of Republican former President George W. Bush.

Democrats want to allow the tax cuts to expire on the wealthiest Americans and leave them in place for everyone else. Republicans want to extend the tax cuts for everyone.

In another sign that Americans are increasingly worrying about their finances as Washington fails to fix the budget crisis, consumer confidence fell to a four-month low in December. The fiscal cliff wrangling in Congress sapped what had been a growing sense of optimism about the economy, a report released on Thursday showed.

"People are hearing about (the "fiscal cliff") and it negatively impacts confidence and investor sentiment and even holiday sales," said Todd Schoenberger, managing partner at Landcolt Capital in New York.

Americans blame Republicans in Congress more than congressional Democrats or Obama for the "fiscal cliff" crisis, a Reuters/Ipsos poll showed.

When asked who they held more responsible for the "fiscal cliff" situation, 27 percent blamed Republicans in Congress, 16 percent blamed Obama and 6 percent pointed to Democrats in Congress. The largest percentage - 31 percent - blamed "all of the above."

Cousins, if you ever have the opportunity, this is a "must do" visit. It is something you will never forget and something you will never tire of talking about.

The oldest house in New England owned and occupied continuously by the same family for over three centuries. Built in 1641.? In 1646 it became the home of Stephen Wing, one of the early settlers of Sandwich, son of the Reverend John Wing and Deborah Bachelor. Stephen?and his descendants occupied the house from then on, adding on as families grew and changing tastes dictated. Now restored, it is furnished almost entirely with Wing family antiques showing the different periods of its long history. The house is maintained by the Wing Family of America and open to the public.

NEW YORK?Playwright Theresa Rebeck looks at the question of perception in her serviceable Broadway comedy ?Dead Accounts,? now at The Music Box Theatre.

In present day Cincinnati, Ohio, Lorna (Katie Holmes) leads an all too quiet life, living in her childhood home with her aging parents: a father with health issues and her usually disapproving mother (Jayne Houdyshell). As she says to her daughter, ?You were never brilliant, but you worked hard.?

Lorna?s status quo lifestyle is suddenly upended by the return of her prodigal brother, Jack (Norbert Leo Butz), a New York banker. He talks a blue streak, loves the local ice cream, and throws money around like water.

Jack also avoids questions about his wife, Jenny (Judy Greer), who nobody in the family likes. While in town, Jack has also made a point of looking up old friends, such as Phil (Josh Hamilton), who has had a crush on Lorna for a very, very long time.

Jack?s almost frantic desire to return to the safety of his old home hides a deep insecurity, as well as the terrible fear of being alone and of losing part of his life that is fast slipping away. The money he?s come into is only a symptom of what?s going on.

It?s this premise, presented almost in the manner of a television sitcom, that allows Rebeck to look at some interesting family dynamics in regard to points of view. Everyone involved is sure they are in the right as different characters take varying positions on Jack?s situation.

There?s also the underlying question of what happens when people and relationships change over time so that nothing is like it once was?if such idealized memories ever really existed in the first place.

The exploration of issues such as these and the very capable and at times hilarious performances of the cast all make this a play worth watching.

Butz wonderfully plays Jack as a human dynamo, a man with a seeming answer for everything, while operating under the premise of never using the truth when a lie will do. Splitting hairs when it comes to ethical issues, he avoids confrontation like the plague, only facing the truth when there is no other option.

Holmes is very good as Lorna, the quiet girl who serves as the glue that holds the family together. As someone stuck in the rut of everyday life, she?s delighted to see her brother, because when he?s around, things start to happen. At the same time, she has her own set of emotional needs and might just find an unexpected chance for happiness before this is over.

Houdyshell often steals the show as Jack and Lorna?s mother. A religious woman, she sees things as black and white, not having time to bother with shades of gray. No-nonsense without being pious and stern, without being unfair, she can cut the strongest and most opinionated person down to size with a withering glance.

Greer does good work as Jenny, though hers is the most underdeveloped character of the piece. Jenny?s stake in Jack?s past actions becomes an ongoing question.

It would have been nice had she appeared less duplicitous in the beginning and allowed more of her feelings to emerge. One feels there is more to this person than revealed, and a more complex character would have certainly added to the story.

Hamilton is deliberately bland as the dependable Phil, whose ?aw shucks? and occasional hangdog attitude end up being rather sweet in his scenes with Holmes.

Direction by Jack O?Brien is fine, keeping the story moving nicely and letting the actors (Butz especially) take their characters wherever they need to go. The piece probably could have been trimmed though, as the entire first act is one long setup for what comes later. However, once Jack?s big secret is revealed, things quickly get interesting.

David Rockwell?s kitchen set is nice and the lighting design by David Weiner, especially as executed at the close of the play, works well.

Cute and funny, with some hysterical laugh lines and some interesting points to make, ?Dead Accounts,? a term in the banking business, makes for an enjoyable, if not an always sparkling experience.

The Emergency Manager in Wheeler County is reporting damage Monday afternoon following a possible tornado.

The Emergency Manager in Wheeler County is reporting damage Monday afternoon following a possible tornado. The National Weather Service had issued a tornado warning for the area around 2 p.m. Monday.

The damage was reported just outside of Glenwood where there are downed trees along with some trees with the tops torn off of them.

The National Weather Service will have a team of meteorologists in that area Tuesday to determine if a tornado is responsible.

Rhapsody for iPadChristmas is just a week away now, and it seems tech companies are having their elves work overtime in order to push out new products before the App Store shuts down for the holidays. There are even a few good deals to be found within today's news recap, especially if you're in the market for inexpensive cloud storage or unlimited streaming music over the holiday break.

Apple Releases Mac Wi-Fi Update, EFI for iMac, 13-inch Retina MacBook

Apple spent Monday afternoon pushing out a trio of updates for its latest Mac computers. First up is Mac Wi-Fi Update 1.0, a recommended patch for all late 2012 Mac models which "improves compatibility when using the 5GHz band in Wi-Fi." Next up is the iMac EFI Update 2.0 for the company's latest late 2012 iMacs, with "general performance fixes pertaining to sleep and Thunderbolt," and also rolls in the aforementioned Wi-Fi update as well. Last but certainly not least is MacBook Pro Retina EFI Update v1.1, which is targeted strictly at late 2012 13-inch MacBook Pro with Retina Display models. "This update improves sleep performance, enhances Thunderbolt router support, fixes an HDMI display issue, and improves compatibility when using the 5GHz band in Wi-Fi," the brief release notes read. The updates can be found in the Mac App Store or by clicking the links above to download them directly.

Camera+ 3.7 Introduces New Quality Setting

Quality: It's what most developers strive for, and Camera+ maker tap tap tap continues to achieve, most recently with Monday's update to its camera replacement app. Indeed, the 3.7 update (which is actually 1.2 for iPad) introduces a new Quality setting, adding High to the Normal and Optimized options. This setting affects how images are shot, shared and saved, but the extra quality does come with a cost -- namely slower performance and larger photo sizes. But if you have a current iOS device with plenty of storage, this may be the setting for you. The developer has also bumped up the quality of shared images sent via the Twitter, Message and Web Link options, so even if you opt not to go for High Quality, you'll be getting some improvements automatically. The latest Camera+ update is now available as a free update for existing users.

iOS 6.1 took another baby step toward release on Monday, as 9to5Mac reported a fourth beta has been seeded to developers. Weighing in at 98.9MB, the over-the-air iOS 6.1 Beta 4 update arrives alongside a new preview of Xcode 4.6 as well as an updated Apple TV beta, which should keep developers busy over the holiday break getting their apps ready for the latest and greatest version.

Next month, the US Supreme Court will hear oral arguments in commercial property case?Koontz vs. St. Johns River Water Management District. Koontz is an interesting and lengthy case, begun 18 years ago in 1994 when Florida landowner Coy Koontz applied for a permit to develop land he had bought years earlier in 1972.

?

At the time of the 17.9 acre vacant lot?s purchase, according to court filings, Koontz?s property, located at the intersection of two state highways, was unencumbered by state and local regulations, and land-use law permitted him full use of his property. ?By 1994, that had changed significantly.

?

In 1985, Florida enacted an environmental statute implementing regulations to control the use of private property containing wetlands and uplands suitable for fish and wildlife habitat. By 1994, all but 1.4 acres of Koontz?s property was included in a Habitat Protection Zone overseen by the St. Johns River Water Management District.

?

Mr Koontz submitted applications for development in 1994,?including?mitigations for the disturbance to the habitat, as per district regulations. ?He offered to place eleven acres of his property into a conservation easement.

?

According to court filings, the district?s response was that they would recommend to deny the permit unless Mr. Koontz, in addition to the surrender of 11 acres of his property, financed the restoration and enhancement of at least 50 acres of welands on District-owned property miles away, by replacing culverts, digging ditches and building a road.

?

In 1994, Mr Koontz filed an action against the District which was only heard eventually in 2002 on the question ?wether the off-site mitigation required by the District was an unreasonable exercise of police power?. ?The court found for the landowner, causing the District to approve the permit without the work it had required to be done on land located miles away. ?Damages were also awarded to Mr. Koontz.

However, the District appealed the case, and this is where the road to the Supreme Court really begins.

In the appeal, the District did not challenge any factual findings in the lower court case, but instead attacked the applicability of cases Mr. Koontz?s attorneys had argued were applicable to the exaction the District sought from Mr. Koontz, cases named Nollan vs. California Costal Commission and Dolan vs. City of Tigard. ?The technical legal argument about the specifics of takings by the state ? which Koontz?s legal team hard argued applied ? was now back on the table.

The Florida Appellate court found for Mr. Koontz, then the Florida Supreme court found against him.

The Supreme Court is up to hear the case and settle it once and for all on January 15th.

Six Degrees of Military Spending

The Department of Defense, with its 2.3 million workers, is the single largest employer in the United States. The defense industry, which is the main private-sector recipient of defense dollars, directly or indirectly employs another 3 million people. This, in a nutshell, is why it?s so hard to cut government spending in general and military spending in particular.

The scope and reach of the government are far bigger than we think, explains John J. Dilulio of the National Academy of Public Administration in the Spring 2012 issue of National Affairs. It?s more than just the money Washington spends or the people it employs. It?s also the people in the private sector who live off that spending. It?s the nonprofit organizations paid to help administer government programs. It?s the contractors who run the programs, the contractors? sub-contractors, and so on.

Dilulio calls this interconnected mass ?BIG PAP,? short for ?Big Inter-Government? and its ?Private Administration Proxies.? In 2012, for example, the Department of Defense shelled out $688 billion to cover, among other things, the salaries of some 801,000 civilian employees and 766,000 contractors. The Pentagon?s BIG PAP therefore amounts to more people than the headcount of the active duty military. The biggest contractor, Lockheed Martin, hires an additional 40,000 subcontractors as well.

If you live in northern Virginia, the most military-heavy region of the state that receives more Pentagon money than any other, you almost certainly know someone who works for the Department of Defense or one of its contractors or sub-contractors, or who is married to someone else who does. While Virginia takes top dollar, a 2011 Congressional Research Service (CRS) report notes that the Defense Department is by far ?the top federal employer in most states.? It also employs ?more than 90 percent of federal civilian employees in foreign countries.? BIG PAP is everywhere.

The business of government is extremely lucrative. As The Washington Examiner?s Tim Carney noted in a September column, the three counties in America that have a median income above $100,000 are all in northern Virginia, and seven of the 10 richest counties are all within commuting distance of the District of Columbia. As he concludes, ?You can surmise where the wealth is coming from: the expanding federal government.?

On average, federal employees are paid more than their counterparts in the private sector. A 2009 study by Chris Edwards, director of fiscal studies at the Cato Institute, found that the average federal civilian worker now earns twice as much in wages and benefits as the average private-sector worker. According to the CRS, the average 2010 salary in the federal government was $74,800, compared to a national average of $44,400 for all workers. The difference is even more pronounced within the military industry. A March 2012 report by the consulting firm Deloitte found that roughly 80 percent of aerospace and defense industry employment is paid for mostly by the government, and that in 2010 the average wage for their industry was $80,100.

The biggest military contractors end up relying on the Pentagon for the vast majority of their sales. According to USAspending.gov, the five top recipients of Defense Department contracts, loans, and loan guarantees are Lockheed Martin, Boeing, General Dynamics, Raytheon, and Northrop Grumman. In 2010, the percentage of overall company sales that the federal government accounted for was, respectively, 60 percent, 82 percent, 63 percent, 88 percent, and 92 percent.

The money blasting out from Washington is notoriously?and predictably?misspent. Congress reliably fails to apply any kind of meaningful oversight over military spending, and it hasn?t even managed to pass a budget since 2009. Individual members of Congress make things worse by pushing for whatever weapons system or aircraft engine that can be produced in their district, regardless of whether the Pentagon wants it.

The Hoover Institution economist David R. Henderson gives an example in a July 2012 Mercatus Center working paper: House Speaker John Boehner (R-Ohio) pushed to fund an alternate engine for the F-35 joint strike fighter over the objections of Defense Secretary Robert Gates (who said it ?would be a waste of nearly $3 billion?), simply because the engine?s manufacturer had ?about 1,000 employees working on the engine in a facility near Cincinnati? at the time.

Extended periods of war solidify this pathology, knitting Pentagon contractors into the fabric of big government. A May 2011 CRS report noted that the Defense Department had more contractor personnel than uniformed personnel in Afghanistan and Iraq. It added that the department spent $11.8 billion on contracts in Afghanistan and surrounding countries in FY2010. Needless to say, these contractors are unlikely to consider the end of the conflict good for business.

Even when military contractors? profits have reached an all-time high, Congress seems committed to sheltering the companies from any budget cuts. Industry lobbying probably plays a role here. According to the Center for Responsive Politics, the U.S. defense and aerospace lobby doled out $24 million to political campaigns and committees during the 2008 campaign cycle and spent nearly $60 million on lobbying in 2011. Lockheed Martin alone spent $15 million in 2011 on its lobbying efforts, plus $2 million in political contributions. Boeing spent $16 million on lobbying the same year.?

In his seminal 1971 article ?The Theory of Economic Regulation,? the Nobel-winning economist George Stigler noted that agencies eventually become captive of the very interest groups they were ostensibly designed to police. Writing regulation or even spending legislation requires in-depth industry knowledge, so federal agencies and lawmakers tend to hire directly from the very companies they must oversee or spend money on.?

The reverse is true too. In order to gain better access to their regulators and government funds, companies hire lobbyists who used to work for Congress or government agencies. Of the 408 lobbyists employed by the military industry to apply pressure on Congress, 70 percent used to work on Capitol Hill.

In the face of this relentless pressure to expand military spending, there are still reasons to be optimistic. In the 1990s, the only category that allegedly limited-government Republican lawmakers really ended up cutting was Pentagon spending, thanks to the peace dividend when the nation ramped down at the end of the Cold War. Perhaps we can manage at least that much this time around. ?

One of the quirks we encountered with Kingston's original Wi-Drive was its capacity. For a device that's all about expanding storage for Android and iOS devices, it didn't have much more to offer beyond what we already had. We can at least put that issue to bed now that there's a 128GB version. The extra space doesn't change the WiFi drive's four-hour battery life or design, but it will give more breathing room than virtually any current microSD card. Although there's no immediate mention of a price, we're seeing the 128GB capacity on sale for $181, or about twice as much as a 32GB edition -- a small enough gap to suggest that going bigger is better.

Policeman complicit in Putin critic murder sentenced

MOSCOW (Reuters) - A former policeman found guilty in the 2006 killing of Russian investigative journalist Anna Politkovskaya, a fierce critic of Vladimir Putin, was sentenced on Friday to spend 11 years in a penal colony.

Dmitry Pavlyuchenkov also was fined 3 million roubles ($97,800) for staking out Politkovskaya's apartment and giving the killer the gun with which she was shot four times, including once in the head, on the president's birthday on October 7, 2006.

But the brief trial in Moscow did not reveal who ordered her killing and a lawyer representing her family said she would appeal against the reduced sentence, handed down under a plea bargain struck in exchange for Pavlyuchenkov's cooperation.

"We are happy that ... at least one person involved in this case has been held responsible," lawyer Anna Stavitskaya said. "(But) he should have been given a longer jail sentence than just 11 years."

Pavlyuchenkov asked for forgiveness before briefly requiring medical assistance while awaiting the ruling.

"Please, as much as it's possible, forgive me. That's all I can say," he told the Moscow court.

The alleged killer and four others are to be tried separately in a case that has come to symbolize the muffling of free speech and the corruption of the judiciary since Putin rose to power in 2000.

Politkovskaya, who was 58, was shot dead in the hallway of her Moscow apartment building after returning home from a grocery store with her shopping.

She had made enemies by reporting on corruption across Russia and on human rights abuses in Chechnya, the unruly North Caucasus region where Moscow waged two wars against separatists after the Soviet Union's collapse in 1991.

Some of her dispatches sharply criticized Putin, who sent troops to Chechnya in 1999 after becoming prime minister.

He condemned the murder four days after Politkovskaya's death but also said her ability to influence Russia's political life had been "extremely insignificant" and that her killing had caused greater damage to Russia than her writings.

Politkovskaya's former colleagues, friends and family say he should be pressed harder to provide the names of the people who commissioned the killing.

The case is one of at least a dozen murders of Russian journalists whose killings have gone unsolved.

Rights groups and Politkovskaya's colleagues at the independent newspaper Novaya Gazeta where she worked have criticized the slow pace of the investigation and expressed doubt it will reveal who ultimately was behind her killing.
