Nexus 7 preorders start shipping in UK and Canada

The Nexus 7 machine is in full swing. According to Google, all pre-orders placed by Friday the 13th in the US and Australia have been filled as of today (though some may still be en route), and our friends in the UK and Canada should be receiving theirs soon enough. Deliveries are currently heading out in waves, putting 7-inches of Jelly Bean in the hands of eager "footie" fans and beneficiaries of socialized medicine. Have you gotten your shipment notification yet? Let us know in the comments.

Update: Google has since changed the wording on its site and, unfortunately, not "all" US and Australian have shipped. Now it's just "many."

Update 2: Google has changed the wording yet again, now providing more detail broken down by model. As of 7:50~ ET, it indicates all standalone 8GB versions ordered on or before July 13th have been shipped, while standalone 16GB orders placed on or before July 11th will all be shipped by the 19th, and have also been upgraded to overnight shipping. Ordered with accessories like a case, charger or Nexus Q? Your slate will ship, overnight, this week although the extra bits may be following "soon." Got it? 1. Pride is a great feeling but mostly it?s overrated. After breaking up with your ex, try to find in yourself the faults that lead to the breakup. Admit your own mistakes. They might even go out with somebody else in the meantime but don?t overreact, even if it hurts. Start your own new friendships, and once your ex sees you with other people as well, and he will quickly dump the new person in favor of getting back with you.

To get back your ex takes more than this, but these initial first steps are mandatory to win your ex back and gain back that romantic relationship you had before it got destroyed.

Alaska town elects a cat for mayor

TALKEETNA, Alaska, July 15 (UPI) -- A cat named Stubbs has been the mayor of a small Alaskan town for about 15 years, locals say.

Known locally as "Mayor Stubbs," the part-manx was named mayor of Talkeetna shortly after he was born, KTUU-TV, Anchorage, Alaska, reported.

As the story goes, about 15 years ago, some residents of Talkeetna were unhappy with the candidates who were running for mayor, so as a joke, they encouraged others to elect Stubbs the cat as a write-in candidate, and he actually won.

Since then, he has held the title of honorary mayor.

Stubbs mostly hangs out at Nagley's General Store, where thousands of tourists ask to see him every year, the report said.

"Oh my gosh, we probably have 30 to 40 people a day come in who are tourists wanting to see him," said Lauri Stec, who works at Nagley's.

Summary:
I think the One X has the best display in the business hands down. It's big, it's bright, and very clear and easy on the eyes. Video looks awesome too.

The Motorola Atrix HD was far more impressive than I expected. It's incredibly sharp, and the brightness was probably the best of all the phones.

Then comes the iPhone 4S. It's still one of the brightest, sharpest screens on the market, despite being released in 2010. Text looks great with a hint of anti-aliasing to soften the edges, colors are slightly understated, but natural looking, with great sharpness when content is zoomed in or out.

Very simply, the iPhone 4S screen is still one of the best in the business.

Edit: The Sony Xperia iON was a surprising sleeper in terms of displays.

Mitt Romney Didn't Learn His Father's Lessons About Civil Rights, Black Caucus Members Say

WASHINGTON -- Prominent members of the Congressional Black Caucus gave MItt Romney points for speaking to the NAACP Wednesday -- but said he clearly didn't learn whatever lessons his father taught him about civil rights and the right to vote.

Romney, the presumptive Republican presidential nominee, addressed the venerable civil rights organization in Houston at its annual convention, the day after Attorney General Eric Holder spoke there and slammed the state of Texas for trying to enforce a voter identification law that has been blocked by the Justice Department on grounds that it would deny deserving people the right to vote. The case is being litigated this week in federal court.

Holder said the ID law amounted to a poll tax because it would be too costly for many poorer voters -- including African Americans and Latinos -- to obtain the documents the law requires. Holder said about 25 percent of black people do not posses the required ID, and his office would not let such laws roll back voting rights that have only expanded in America's history.

"We will simply not allow this era to be the beginning of the reversal of that historic progress," Holder said.

But Romney backs laws like the one in Texas, and made no comments about it, even as he invoked his father, former Michigan Gov. George Romney, as a model Romney looks to because of his support for civil rights in the '60s and '70s.

"Always in both parties there have been men and women of integrity, decency and humility who have called injustice by its name," Romney said. "For every one of us, a particular person comes to mind. Someone who set a standard of conduct and made us better by their example. For me that man is my father," citing the elder Romney's faith in God, his role writing civil rights legislation in Michigan, and his participation in rights marches in Detroit.

But Democrats, themselves veterans of the civil rights movement, said they didn't think Romney had learned well enough from his father's example.

"A lot of children are very selective about what they listen to from their parents, and Romney is very selective about that," said Rep. James Clyburn (S.C.), the chairman of the House Democratic Caucus.

Congressional Black Caucus Chairman Rep. Emanuel Cleaver (D-Mo.) praised Romney for addressing the NAACP, but also said he thought Romney missed a chance to deal with an issue that has personal relevance for many black Americans, including Cleaver, who was born in Texas.

"My grandfather ... lived to be 103 and never voted," Cleaver said. "In Texas, you had to pay a poll tax. Even if the poll tax was $1.50, and if you were born in 1852, whatever it was, that's a lot of money.

"In America, we ought to be encouraging people, and I don't think that that's were Gov. Romney is, unfortunately," Cleaver added. "I think in Texas, it would have been good for him to talk about his strong and unbending support for access to the ballot box by all. But if he had said that, he would have lost support" in the GOP base.

Conservatives have been pushing for voter ID laws across the nation. Their opponents say the movement is an attempt to disenfranchise minorities and poorer voters who tend to vote Democratic.

Some of the laws, like Texas', have been blocked by the Department of Justice, and are being contested in courts.

Google+ updated with native iPad support

After what felt like an eternity for many users, Google has updated their social networking app Google+ to include native iPad support. It features a side-scrolling stream and lots of gestures to interact with content. The content on your stream is also styled based on popularity, type and orientation. The iPhone version of Google+ also now includes the ability to create and manage Google+ events.

The layout of Google+ on the iPad is very nice and displays content in squares. A little less than six square fit on the screen at a time and some content will take up two or four squares. Google+ determines this styling based on popularity, type, and orientation. I'm a fan of this styling as it adds some variety to my stream and is visually appealing.

To scroll through your stream while in landscape, you actually scroll left and right, not up and down. This was strange at first, because I naturally wanted to scroll up and down, but the side-scrolling is actually superior when using Google+ in landscape orientation because of the way the boxes of content fit on the screen. When in portrait orientation, scrolling is the more traditional up and down. My only complaint about scrolling is that it's not very smooth. I always expect apps to have buttery smooth scrolling; unfortunately, Google+ doesn't provide such an experience.

When you tap on content in your Google+ stream, the image will take over the background and the links and text from the content will appear in the center of the bottom of the screen. From here, you can reply, share, +1, or leave a comment. You can also scroll through all the comments left on the post. As you scroll, the popup will expand upwards over the photo in the background. I really like the implementation of photos in the background, but for small images that don't take up the entire screen, the little popup will cover too much of the photo.

You can also add +1 and add comments to posts in your stream by tapping the designated button on the content boxes.

One of the really cool gestures of Google+ for iPad is how you share content from your stream. Simply "grab" the post with two fingers. The outline of a box will appear in the upper right corner indicating where to drag the content to. When you do, the outlined box will transform into a box where you can "share your thoughts" and indicates who originally shared the post.

Sharing original content is very similar. Just tap the little pen icon in the upper right corner. Three little boxes will slide out from the right for adding a status/text, photo, or location.

Tapping the icon in the upper left will slide out a column that displays your notifications as well as access to your Home, Profile, Hangout, Find People, and Settings pages.

The good

  • Very nice design
  • Pinch or tap to expand posts
  • Use two fingers to drag a post from your stream to easily re-share it
  • Start a Hangout from your iPad and stream it to your TV using AirPlay

The bad

  • Scrolling could use a lot of work

The conclusion

Google is off to a great start with Google+ for iPad. It's gorgeous and features a lot of fun and helpful gestures. However, the scrolling is far from perfect and has a serious impact on the experience. Hopefully Google address that soon -- especially since I'm testing on a 3rd generation iPad. I don't even want to know what the experience is like on a 1st generation iPad.

Facebook use leads to depression? No, says study

ScienceDaily (July 9, 2012) ? A study of university students is the first evidence to refute the supposed link between depression and the amount of time spent on Facebook and other social-media sites.

The University of Wisconsin School of Medicine and Public Health study suggests that it may be unnecessarily alarming to advise patients and parents on the risk of "Facebook Depression" based solely on the amount of Internet use.

The results are published online July 9 in the Journal of Adolescent Health.

Last year, the American Academy of Pediatrics released a report on the effects of social media on children and adolescents. The report suggested that exposure to Facebook could lead to depression.

Researchers led by Lauren Jelenchick and Dr. Megan Moreno surveyed 190 University of Wisconsin-Madison students between the ages of 18 and 23, using a real-time assessment of Internet activity and a validated, clinical screening method for depression.

The students were surveyed with 43 text-message questionnaires at random intervals over a seven-day period between February and December of 2011. The students were asked if they were currently online, how many minutes they had been online and what they were doing on the Internet.

The study found that the survey participants were on Facebook for over half of the total time online. When Jelenchick and Moreno evaluated the data including the depression-screening results, they found no significant associations between social-media use and the probability of depression.

"Our study is the first to present scientific evidence on the suggested link between social-media use and risk of depression," said Jelenchick, who just received a master's degree in public health from the University of Wisconsin School of Medicine and Public Health. "The findings have important implications for clinicians who may prematurely alarm parents about social-media use and depression risks."

Moreno, a pediatrician who has been widely published in the area of social-media use among children and adolescents, advises parents to look at their children's social-media use in the context of their entire lives.

She says parents don't have to be overly concerned if their child's behavior and mood haven't changed, they have friends and their school work is consistent.

"While the amount of time on Facebook is not associated with depression, we encourage parents to be active role models and teachers on safe and balanced media use for their children," said Moreno.

According to recent studies, more than 70 percent of adolescents use social media sites, most commonly Facebook.

Why are all these conservatives beating up on Mitt Romney?

Mitt Romney has been taking flak from some prominent conservatives. They want to see a specific plan for the economy, and some say the fancy vacation home feeds the rich-guy image.

Probably not, because it looks like the Romney clan is having too much fun boating and barbecuing at their vacation compound up on Lake Winnipesaukee in New Hampshire.

But the presumptive Republican presidential nominee has been taking flak from some prominent sources among his normally-supportive fellow conservatives.

On ?Fox News Sunday,? it was Weekly Standard editor William Kristol. He said Romney needs to do more than just cite the nation?s economic woes as reason enough to oust President Obama. He needs to articulate a plan, Kristol said, not only on the economy but on other key issues including health care.

It worries him, he said, that Obama is ?holding his own? in polls despite three months of disappointing jobs figures. More to the point, Kristol pointed out, only 27 percent of those polled by Fox News think Romney has a clear plan for improving the economy.

?I don't think you can beat an incumbent president even if the economy?s slow if 27 percent of the voters think you as the challenger don't have a clear plan for improving the economy,? he said.

Earlier in the week, Kristol was more explicit in his Weekly Standard blog.

?Voters?want to hear what Romney is going to?do?about the economy,? he wrote. ?He can ?speak about? how bad the economy is all he wants ? though Americans are already well aware of the economy's problems ? but doesn't the content of what Romney has to say matter? What is his economic growth agenda? His deficit reform agenda? His health care reform agenda? His tax reform agenda? His replacement for Dodd-Frank??

Kristol isn?t the only one poking Romney.

The headline on a piece by Forbes columnist John Tamny (which was mainly critical of Obama) reads ?It's Time For Mitt Romney And His Economic Team To Grow Up.?

"When is Romney going to look like a?challenger? Seems to play everything safe,? conservative media mogul Rupert Murdoch recently tweeted. Obama ?will be hard to beat unless [Romney] drops old friends from team and hires some real pros.?

Former General Electric CEO Jack Welch concurred, tweeting ?Hope Mitt Romney is listening to Murdoch advice..playing in league with Chicago pols..No room for amateurs.?

Conservative radio host Laura Ingraham wondered why Romney was taking time off for a vacation when ?we have a country to save,? suggesting that he should ?get out there on the trail and?get off the jet ski.?

In its response to the question of whether the health care mandate penalty is a ?tax? on those who chose not to have health care insurance, the Wall Street Journal charged, ?the [Romney] campaign looks confused in addition to being politically dumb.?

In a tough editorial which startled many observers, the Wall Street Journal echoed the criticism of Kristol and other conservatives that Romney needs to get more specific about how he?d be a better president than Obama.

?The Romney campaign thinks it can play it safe and coast to the White House by saying the economy stinks and it's Mr. Obama's fault. We're on its email list and the main daily message from the campaign is that ?Obama isn't working.? Thanks, guys, but Americans already know that. What they want to hear from the challenger is some understanding of why the President's policies aren't working and how Mr. Romney's policies will do better.?

?Meanwhile, the Obama campaign is assailing Mr. Romney as an out-of-touch rich man, and the rich man obliged by vacationing this week at his lake-side home with a jet-ski cameo,? the editorial continued. ?Mr. Romney promised Republicans he was the best man to make the case against President Obama, whom they desperately want to defeat. So far Mr. Romney is letting them down.?

Heat not enough? Twisters might be next

Investigators say at least two deaths in the Midwest are the result of the sweltering heat that continues to cook the region. NBC's John Yang reports.

Mother Nature is adding insult to injury: With a heat wave continuing to bake the Midwest and Mid-Atlantic, isolated storms have added to the power outages from last weekend's storms.

Friday's forecast calls for a chance of another storm front. That would certainly cool things off, but it could also mean new outages -- and?one or more tornadoes. "Large hail and damaging winds" could hit the upper Midwest by Friday evening, the National Weather Service said. "There also appears to be a window of opportunity for a tornado or two immediately along the warm front this evening."

West Virginia on Thursday saw a new storm and new power outages, while the same happened in Michigan on Wednesday.

At least 406,000 people were without electricity on Friday in West Virginia, Virginia, Maryland and Ohio, power companies said.

With the heat spreading east over the weekend, excessive-heat warnings remained in place Friday for all of Iowa, Indiana and Illinois as well as much of Wisconsin, Michigan, Missouri, Ohio and Kentucky.


St. Louis hit a record high of 105 on Wednesday and a record low of 83. In Wisconsin, the coolest Milwaukee and Madison got was 81 in the early morning, beating previous low records by 2 and 4 degrees respectively. Temperatures didn't fall below 79 in Chicago, 78 in Grand Rapids, Mich., and 75 in Indianapolis.

"When a day starts out that warm, it doesn't take as much time to reach high temperatures in the low 100s," said Marcia Cronce, a meteorologist with the National Weather Service. "You know it'll be a warm day when you start out at 80 degrees."

When the air conditioner stopped in Ashley Jackson's Southfield, Mich., home, so too did normal conversations and nightly rest.?

"Inside the house it was 91 degrees. ... I wasn't talking to anybody. Nobody was talking to anybody," said Jackson, 23, who works as a short-order cook in Detroit. "We mostly slept, but it was hard to sleep because of the heat. I probably got about four hours of sleep each night."

St. Louis, Milwaukee, Minneapolis, Chicago and several other Midwest cities already have broken heat records this week or are on the verge of doing so. And with even low temperatures setting record highs, some residents have no means of relief, day or night.

In Chicago on Thursday, the Shedd Aquarium lost power as temperatures soared to 103 degrees, a record for July 5. Officials said emergency generators immediately kicked in and the outage never threatened any of animals, but several hundred visitors were sent back out into the heat.

Celebrating the warm summer months, as schools let out and the cooling off begins

The heat returned Thursday and not even the setting of the sun brought respite as temperatures hovered around 90 degrees downtown at 10 p.m. Some visitors made their way to Millennium Park to splash in the park's kid-friendly Crown Fountain.

"It's hotter here than it is in Arizona," said Mary Dominis, of Tempe, who brought her daughter along to play in the water. "I came here to visit my family and to get away from the heat of Arizona."?

Ruben Davila, 32, of Northern California, was also in Chicago visiting family, and at the park seeking some cool relief.?

"The heat has made it difficult to walk around and view the sites," said Davila, who was accompanied by his wife and three children.?

The heat has been much worse than a mere inconvenience for some. St. Louis officials have reported three heat-related deaths in recent days, and officials in the Chicago area said two people there may have died due to heat Wednesday. A coroner in Rock County, Wis., said the death of an 83-year-old woman there was definitely due to the heat.?

It was hot enough to buckle a roadway Wednesday afternoon in Chicago, where Columbus Drive cracked and bulged, forcing the city to close the road for repairs.?

And with the National Weather Service's excessive heat warning for the city extended through Friday evening, Chicago Public Schools CEO Jean-Claude Brizard cancelled all summer school classes for the day.?

Meanwhile, many cities have tried to help by opening cooling centers and extending the hours for their public pools. Compounding the high heat in Michigan was damage wrought by storms. About 157,000 homes and businesses across the state were without power early Friday.?

Lack of electricity also is likely to compound the misery for many in the storm-ravaged East as the dangerous temperatures move in. Outages reported as late Thursday included nearly 230,000 in West Virginia and more than 83,000 in Virginia.?

Maryland, which still had more than 45,000 without power, also reported Thursday that eight people had died of heat-related causes in recent days.?

The heat has also taken a toll on agriculture.?

Dean Hines, the owner of Hines Ranch Inc. in the western Wisconsin town of Ellsworth, said he found one of his 80 dairy cows dead Thursday, an apparent victim of the heat. He said he was worried about the rest of his herd, in terms of death toll, reproductive consequences and milk production.?

"We're using fans and misters to keep them cool," he said. "It's been terrible. When it doesn't cool down at night, the poor animals don't have a chance to cool down."

(AP) ? Serena Williams reached her eighth Wimbledon semifinal by knocking out defending champion Petra Kvitova in straight sets with another commanding serving performance on Tuesday.

Playing underneath the closed roof on Centre Court while rain halted play elsewhere at the All England Club, Williams hit 13 aces ? including three in the last game ? to beat the fourth-seeded Czech 6-3, 7-5.

Kvitova was on an 11-match winning streak at Wimbledon and had not lost here since Williams beat her in the 2010 semifinals en route to her fourth title.

"She's been playing so well on grass," Williams said. "I had absolutely nothing to lose."

The American four-time champion seized control by breaking Kvitova for a 4-2 lead in the first set and then never gave her opponent a chance to get back in the match. She saved a set point when trailing 5-4 in the second with a hard serve down the middle that Kvitova could return only into the net. That was the only break point the defending champion earned, as Williams won 86 percent of the points on her first serve.

Kvitova then led 30-0 in the next game but made four straight mistakes ? including netting an easy forehand on break point ? to give Williams the opening she needed.

Williams, who hit a Wimbledon-record 23 aces in a fourth-round win over Zheng Jie of China, is trying to become the first woman over 30 to win a Grand Slam title since Martina Navratilova won Wimbledon in 1990.

Outside Centre Court, it was a start-and-stop day at Wimbledon, as showers continued to cause headaches for organizers.

Play was delayed for about 30 minutes on the outside courts in the morning, although Andy Murray and Florian Mayer found enough time between the showers to wrap up suspended matches and reach the quarterfinals.

David Ferrer also advanced in the first match on Centre Court, where organizers again came under scrutiny for their use of the retractable roof. Their decision to open and then close it caused the start of Ferrer's match against Juan Martin del Potro to be delayed by about 40 minutes.

Murray made the last eight for the fifth straight year by beating the 16th-seeded Marin Cilic 7-5, 6-2, 6-3, while Mayer ousted Richard Gasquet of France 6-3, 6-1, 3-6, 6-2. American qualifier Brian Baker's remarkable run ended with a 6-1, 7-6 (4), 6-3 loss to 27th-seeded Philipp Kohlschreiber of Germany.

Rain had prevented five of the men's fourth-round matches from being completed on Monday. The weather continued to cause headaches as the start of play on outside courts was delayed for about 30 minutes because of light showers. When matches started, they were quickly halted again for another rain delay of about an hour.

"We stopped, obviously, a lot," Murray said. "You're always a little bit edgy when you come out after a rain delay when you have the momentum with you. You stop, and then you come back out, and it feels a bit like you start from scratch again. I needed to serve well today and I got a lot of free points that helped me out."

Play on Centre Court didn't even have time to start at all before the rain came. Organizers had closed the roof because of earlier showers in the morning but then decided to open it during a dry spell just before Ferrer's match against del Potro. When the showers resumed, they promptly had to close it again and keep the players waiting.

When the match began, Ferrer needed less than two hours to beat del Potro 6-3, 6-2, 6-3. Another rain delay then forced the suspension of Jo-Wilfried Tsonga's match against Mardy Fish, with the fifth-seeded Frenchman leading 4-6, 7-6 (4), 6-4, 4-2.

Murray's match was halted on Monday with the Briton leading 3-1, 40-0 in the second set. He had time to play one point on Court 1 ? clinching that game ? before rain started falling again. One game later, the match was suspended once more. After the second resumption, there was another slight break early in the third set as the players remained in their chairs for about five minutes under umbrellas as officials waited for a light shower to subside.

The Briton's victory never looked in doubt, though, and he served out the match to love when the Croat netted a backhand. Murray will next play Ferrer as he tries to become the first British man to win Wimbledon since 1936 ? a task that looks easier after Rafael Nadal was knocked out in the second round last week.

The 126th-ranked Baker was trying to become the third American qualifier to reach the quarterfinals at the All England Club. He was playing in Wimbledon's main draw for the first time after being off the tour for more than five years because of a series of operations, one on his right elbow. He was ranked 458th at the start of 2012 but now will rise inside the top 100.

On Monday, top-ranked Novak Djokovic, Roger Federer and Mikhail Youzhny were the only men to complete their round of 16 matches.

In lieu of equations, physicists tend to explain the process in terms of sports and syrup.

First, each of the elementary particles acquires its unique set of attributes by interacting with invisible entities called fields. Like football fields, these are large stages upon which individuals (be they electrons or running backs) dash this way and that, and occasionally bash together. But unlike football fields, the fields of physics are three-dimensional, and?extend infinitely in all directions.

One such field is the electromagnetic (EM) field ? the kind you can feel near the poles of a red and silver?bar magnet, but which actually exists everywhere all the time. Each particle interacts with the EM field in a way that depends on its electric charge. For example, electrons, whose charge is -1, tend to move through the field toward the positive ends of bar magnets, and to clump together with positively charged protons.

Like a sports field with its corresponding ball, each field of physics has a corresponding particle. The EM field, for example, is associated with the photon, or particle of light. This correspondence plays out in two ways: First, when the EM field is "excited," meaning its energy is flared up in a certain spot, that flare-up is, itself, a photon.

Secondly, when particles interact with the EM field (for example, when they are drawn toward the oppositely charged end of a magnet), they experience the field by absorbing and emitting a constant stream of "virtual photons" ? photons that momentarily pop in and out of existence just for the purpose of mediating the particle-field interaction.

There also exists a Higgs field. It gives particles mass.?[How Do You Weigh an Atom?]

Except for masless photons and gluons, "all elementary particles get their masses from their interactions with the [Higgs] field, kind of like being 'slowed down' by passing through a thick syrup," explained James Overduin, a physicist at Towson University in Maryland.

Over 100 costumed characters caused panda-monium on the streets - and the transport network - of London yesterday to highlight Panda Awareness Week.

While Edinburgh may have its own real-life ones, this panda posse performed a tai-chi inspired dance in the middle of Trafalgar Square and travelled on the London Underground.

Panda Awareness Week aims to raise interest and support for the protection of one of the world's most-threatened - and cutest - species.

In total there were 108 of the faux furry things in London yesterday - the same number of pandas that are living in a special breeding centre in China's Chengdu base.

There are only 1,800 of them left in wild.

FDA approves first rapid, take-home HIV test

WASHINGTON (AP) ? Americans will soon be able to test themselves in the privacy of their own homes for the virus that causes AIDS, now that the Food and Drug Administration has approved the first rapid, over-the-counter HIV test.

The OraQuick test detects the presence of HIV antibodies using a mouth swab and returns a result in 20 to 40 minutes.

Government officials estimate that about 240,000 people, or one-fifth of the roughly 1.2 million people carrying HIV in the U.S., don't know they are infected. Testing is a chief means of slowing new infections, which have held steady at about 50,000 per year for two decades.

FDA officials said the test is designed for people who might not otherwise get tested.

"The availability of a home-use HIV test kit provides another option for individuals to get tested so that they can seek medical care, if appropriate," said Dr. Karen Midthun, director of the FDA's Center for Biologics Evaluation and Research.

Orasure plans to start selling the test in October, both online and through retailers like Walgreens, CVS and Walmart. It hasn't set a price yet but expects the consumer version to cost less than $60 but more than the one marketed to health professionals, which costs about $17.50. CEO Doug Michels said the price increase will help pay for a toll-free call center to provide counseling and medical referrals to test users.

"Each of the call-center operators is bilingual in English and Spanish, they've gone through 160 hours of training on HIV counseling and testing," Michels said in an interview with the Associated Press. "So they are highly trained professionals and they'll be there to support the consumer."

Michels said the company's marketing efforts will focus on populations at greatest risk of being infected with HIV, including gay and bisexual men, African Americans and Hispanics.

FDA stressed in its approval announcement that the test is not 100 percent accurate in identifying people with the virus. A trial conducted by test maker Orasure showed OraQuick detected HIV in those carrying the virus only 92 percent of the time, though it was 99.9 percent accurate in ruling out HIV in patients not carrying the virus.

That means the test could miss one in 12 HIV-infected people who use it but would incorrectly identify only one patient as having HIV for every 5,000 HIV-negative people tested, the FDA said.

People who test negative should get re-tested after three months, because it can take several weeks for detectable antibodies to HIV to appear, according to Dr. Jonathan Mermin, director of the Centers for Disease Control and Prevention's HIV unit.

The FDA has approved several other HIV test kits designed for home use, but they usually require a blood sample that must be sent to a laboratory for development.

HIV awareness groups hailed the approval as an important step in expanding testing for the virus.

"This test will allow anyone to empower themselves to know their HIV status when, how and with whom they want to," said Tom Donohue, founding director of Who's Positive.

Experts say it's difficult to predict how widely the test will be used.

According to the Orasure's study, 41 percent of people who discovered they were HIV-positive using OraQuick had never been tested. The company estimates that 9,000 new HIV carriers would be identified for every 1 million people who use the test.

Based in Bethlehem, Pa., Orasure has marketed a version of OraQuick to doctors, nurses and other health care practitioners since 2002. When used by professionals, the test is shown to accurately identify both carriers and non-carriers 99 percent of the time. It's not clear why the test is less accurate in consumer trials, but researchers said they expected its sensitivity to drop when it was used by consumers.

HIV eventually develops into AIDS, unless treated with antiviral drugs. AIDS causes the body's immune system to breakdown, leading to infections which become fatal.

Shares of Orasure Technologies rose 60 cents, or 5.2 percent, to close at $12.10 on Tuesday.

BEIJING (AP) ? Apple has paid $60 million to settle a dispute in China over ownership of the iPad name, a court announced Monday, removing a potential obstacle to sales of the popular tablet computer in the key Chinese market.

Apple's dispute with Shenzhen Proview Technology highlighted the possible pitfalls for global companies in China's infant trademark system. It also posed a challenge for the communist government, which wants to attract technology investors to develop China's economy.

Apple Inc. says it bought the global rights to the iPad name from Proview in 2009 but Chinese authorities say the rights in China were never transferred. A Chinese court ruled in December that Proview still owned the name in China. Proview, which is struggling financially, asked Chinese authorities to seize iPads in an apparent effort to pressure Apple to settle.

"The iPad dispute resolution is ended," the Guangdong High People's Court said in a statement. "Apple Inc. has transferred $60 million to the account of the Guangdong High Court as requested in the mediation letter."

China is Apple's second-largest market after the United States and the source of much of the Cupertino, California-based company's sales growth.

Proview hoped for more money but felt pressure to settle because it needs to pay debts, said a lawyer for the company, Xie Xianghui. He said Proview sought as much as $400 million and might still be declared bankrupt in a separate legal proceeding despite the infusion of settlement money.

"This is a result that is acceptable to both sides," Xie said.

The dispute centered on whether Apple acquired the iPad name in China when it bought rights in various countries from a Proview affiliate in Taiwan for 35,000 British pounds ($55,000). The December court ruling said Proview, which registered the iPad trademark in China in 2001, was not bound by that sale, even though it was part of the same company.

The settlement should be good news for both Apple and its customers because it clears a potential obstacle for the company to start selling the new iPad 3 in China, said You Yunting, a lawyer for the DeBund Law Office in Shanghai.

"It is a good deal for Apple, because sales of iPads, which are in great demand, can compensate for this $60 million cost," You said.

Apple has yet to announce a China release date for the iPad 3 but the country's telecommunications equipment certification agency approved the tablet in May.

The case gave Chinese authorities a chance to show that their courts could impartially resolve intellectual property disputes but also raised the possibility that technology investors might be put off by a negative outcome for Apple. Chinese regulators said Proview clearly owned the mainland name rights under Chinese rules.

Without a formal ruling, it will be hard for companies to draw lessons about how Chinese courts will handle such disputes in the future, said Stan Abrams, an American lawyer who teaches intellectual property law at Beijing's Central University of Finance and Economics.

"It's such an atypical case," he said. "Certainly, the details and specifics of this kind of commercial dispute aren't going to give us any long-term lessons."

The outcome reflects Chinese courts' preference for encouraging adversaries in commercial disputes to settle instead of pushing for a ruling, Abrams said. He said the relatively small size of the settlement by Apple's standards suggested Proview gave in, possibly under pressure from either its creditors or the court.

All of Apple's iPads are made in China by Foxconn Technologies Group, which employs more than 1 million people in sprawling factories. Brazil's government says Taiwan-based Foxconn plans to open factories there to produce iPads and other products.

Shenzhen Proview Technology is a subsidiary of LCD screen maker Proview International Holdings Ltd., headquartered in Hong Kong.

A Hong Kong court ruled in July that Proview and the Taiwan company both were "clearly under the control" of the same Taiwanese businessman, Yang Long-san, and had refused to take steps required to transfer the name under the agreement. The judge said the companies acted together "with the common intention of injuring Apple."

However, that judgment had no automatic force in the mainland case because Hong Kong, while Chinese territory, has a separate legal system.

Apple also ran into a trademark dispute before it launched the iPhone in 2007.

Cisco Systems Inc., the maker of networking hardware, had owned the trademark since 2000 and used it for a line of Internet-connected desk phones. After Cisco sued, the companies reached an undisclosed settlement and the phone launch went off as planned.

The dispute came amid complaints Beijing is failing to stamp out rampant unlicensed Chinese copying of goods ranging from music and Hollywood movies to designer clothing and pharmaceuticals.

But unlike "trademark squatters" who register names of products already sold abroad and then demand foreign companies pay for the Chinese rights, Proview registered the iPad name long before Apple planned its tablet computer.

"The only thing companies really should take form this case is, be careful when you do transactions, be careful with your contracts," Abrams said. "Be careful you're doing it the right way or you could pay a lot for your mistakes."
